§ 25731 County Energy Sales Restrictions

Key Takeaways

  • •Counties can build wind or water power plants and sell the electricity to big companies or other agencies, but not directly to regular people.
  • •The county can use the power for itself, like for water projects, but can't sell it to everyday customers.
  • •If they sell the power, it has to be sold at the 'bus bar,' which is like the main switch where the electricity is sent out.

Example

A county builds a wind farm and makes extra electricity.

The county can sell the extra power to a big electric company, but they can't sell it directly to homes or small businesses. They also can't sell it from just anywhere—it has to be sold at the main switch (bus bar) of the wind farm.

§ 25731 County Energy Sales Restrictions

The hydroelectric or wind energy plant or plants and transmission lines constructed pursuant to Section 25730 may be leased for operation to, or the power generated may be sold to, a public utility or another public agency engaged in the distribution, use, or sale of electricity. The power generated may be used by the county for its own purposes, or for the production or transmission of water, but shall not be offered for sale directly by the county to customers other than to a public utility or another public agency. Any power sold to a public utility or another public agency engaged in the distribution or sale of electricity shall be marketed at the bus bar. For purposes of this section, “bus bar” means the high tension disconnect switch or switches of the hydroelectric or wind energy works. (Amended by Stats. 1982, Ch. 351, Sec. 2.)
