§ 25530 Bid Opening And Acceptance

Key Takeaways

  • •All sealed bids for selling or leasing something must be opened and checked in public.
  • •The highest bid that follows all the rules wins, unless someone offers more money on the spot or all bids are rejected.
  • •If the winning bid includes a fee for a real estate broker, the board pays that fee separately and doesn’t subtract it from the bid.

Example

A county wants to sell an old building and asks for bids. Three people send sealed offers: $100,000, $120,000, and $150,000.

The county opens all bids in public. The $150,000 bid wins because it’s the highest and follows the rules. If that bid includes a $5,000 fee for a broker, the county pays the broker separately and still gets the full $150,000.

Of the proposals submitted which conform to all terms and conditions specified in the resolution of intention to sell or to lease and which are made by responsible bidders, the proposal which is the highest shall be finally accepted, unless a higher oral bid is accepted or the board rejects all bids. In determining which is the highest sealed proposal, the board shall not subtract therefrom the commission, if any, which the proposal provides shall be paid to a licensed real estate broker. If the highest bid provides for such commission, the board shall pay to the broker the commission specified in the resolution, as provided in Section 25527. (Amended by Stats. 1957, Ch. 2109.)
