§ 23386 County Debt And Legal Continuity

Key Takeaways

  • •If a new county is created, old debts or legal problems from the old county don’t just disappear.
  • •Any lawsuits or legal cases involving the old county keep going, even after the new county is formed.
  • •The new county doesn’t get rid of the old county’s money problems or court cases.

Example

Imagine your town splits into two, and the old town owed money to fix the roads.

Even after the split, the new town still has to pay back that money, and any lawsuits about the roads keep going like nothing changed.
