§ 21291 Spouse Pension Division Rights

Key Takeaways

  • •A 'nonmember' is the husband or wife (or ex-husband/ex-wife) of someone in a retirement plan.
  • •If they go to court to split their shared stuff (like money), they can get their own separate retirement account.
  • •This account shows how much they contributed and how long they worked.

Example

A couple gets divorced, and one of them was a teacher with a retirement plan.

The ex-spouse can ask the court to split the retirement money. If the court agrees, the ex-spouse gets their own account with their share of the money and the time the teacher worked.
