§ 21170 Judicial Review Of Wcab

Key Takeaways

  • •The court can only check if the Workers’ Compensation Appeals Board did something wrong, like going beyond their power or acting unfairly.
  • •The court can also check if the Board’s decision was made because of fraud.
  • •The court won’t redo the whole case—just make sure the Board followed the rules.

Example

A worker gets hurt at a construction site and applies for workers’ compensation. The Board says no, but the worker thinks the Board made a mistake.

The court can look at the Board’s decision to see if they acted unfairly or broke the rules. If the Board did everything right, the court won’t change the decision.
