§ 21153 Employer Disability Retirement Duty

• •If an employee is disabled and can retire because of it, the boss can't fire them just because they're disabled.
• •The boss must ask for disability retirement for the employee if they think the employee is disabled.
• •The employee can choose not to retire for disability and instead take their money out or leave it for later retirement.

A firefighter gets hurt on the job and can't work anymore.

The fire department can't just fire the firefighter. They have to ask for disability retirement for them. But the firefighter can say no and take their retirement money out instead.
