§ 19844 Overtime Compensation Rules

Key Takeaways

  • •If you work extra hours (overtime), your boss can pay you more money or give you extra time off later.
  • •The extra pay can be up to 1.5 times your normal pay, or you can get up to 1.5 hours off for every extra hour you work.
  • •The rules for overtime pay or time off depend on what’s common in other jobs and what the state needs.
  • •If there’s a special agreement with workers, that agreement wins—but only if the government approves the money for it.

Example

You work 2 extra hours at your job because there’s an emergency.

Your boss can either pay you 1.5 times your normal pay for those 2 hours or let you take 3 hours off later (1.5 hours for each extra hour you worked).

The provisions made under this section shall be based on the practices of private industry and other public employment, the needs of state service, and internal relationships. (b) If the provisions of this section are in conflict with the provisions of a memorandum of understanding reached pursuant to Section 3517.5, the memorandum of understanding shall be controlling without further legislative action, except that if such provisions of a memorandum of understanding require the expenditure of funds, the provisions shall not become effective unless approved by the Legislature in the annual Budget Act.
