§ 18675 Hearings Investigations Procedures

Key Takeaways

  • •The rules for hearings and investigations are set by the board and must be followed.
  • •Small mistakes in how a hearing is run won’t automatically cancel out the final decision.
  • •When looking into complaints about unfair treatment, harassment, or payback at work, the people in charge must follow current laws and past decisions.
  • •The final decision must explain which laws and past decisions were used to make it.

Example

A state worker files a complaint saying their boss treated them unfairly because of their race.

The people investigating the complaint must follow the board’s rules and look at current laws about workplace fairness. Even if they make a small mistake during the process, like forgetting to record part of the meeting, the final decision can still count. The decision must also list the laws and past cases they used to decide if the boss was wrong.
