§ 17551 State Mandate Reimbursement Claims

Key Takeaways

  • •If the state makes a city or school spend money on something, the city or school can ask the state to pay them back.
  • •They have to ask within 12 months after the rule starts or after they spend the extra money.
  • •If the state's money person (Controller) takes away money by mistake, the city or school can ask to get it back.

Example

A new state law says all schools must buy special computers for students. The school buys them but thinks the state should pay for it.

The school has 12 months to ask the state to pay them back for the computers. If they wait too long, they can't ask anymore.
