§ 17244 Warrant Interest Rate Limits

Key Takeaways

  • •The law lets the government set a maximum interest rate of 12% per year for special loans called 'reimbursement warrants'.
  • •The actual interest rate can be lower than 12% and is decided either by the best bids if sold publicly or by the Controller if sold privately.
  • •The interest rate can be fixed (stays the same) or variable (changes over time).
  • •Different loans can have different interest rates, even if they are the same type of loan.

Example

Imagine the government needs to borrow money to fix roads and issues a loan called a 'reimbursement warrant'.

The government says the highest interest they will pay is 12% per year. If banks offer to lend the money at 10% interest, the government will pay 10% because it’s the best deal. If the loan is sold privately, the Controller might agree to a 9% interest rate. The interest rate could stay the same or change over time, but it won’t go above 12%.

(a) Notwithstanding any other provision of law, in lieu of prescribing a precise interest rate on registered reimbursement warrants, the committee may fix a maximum rate of interest for the warrants, not to exceed 12 percent per annum for either fixed or variable interest rate warrants, and prescribe that the interest rate on the warrants, not in excess of that maximum, shall be either of the following: (1) Fixed in accordance with the best bids for the warrants if the warrants are sold at public sale. (2) Fixed or variable on the terms and conditions the Controller shall approve at the time of sale of the warrants if the warrants are sold in negotiated sales. (b) Different rates of interest for any reimbursement warrants may be so fixed or established by the Controller. (Amended by Stats. 2009, Ch. 23, Sec. 7. Effective July 28, 2009.)
