§ 16760 Bond Validity Legal Opinions

Key Takeaways

  • •The committee can get a second opinion from a lawyer (not the Attorney General) to make sure the bonds are legal.
  • •This second opinion can help sell the bonds for more money or make them easier to sell.
  • •The committee can ask the State Treasurer or the Department of Finance to get this opinion before or after selling the bonds.

Example

Imagine you're selling lemonade to raise money for your school. You want to make sure it's okay to sell it, so you ask your teacher. But to be extra sure, you also ask the principal. This way, more people might trust your lemonade and buy it.

In this law, the committee is like you selling lemonade. They can ask another lawyer (not just the Attorney General) to make sure the bonds are okay. This can help them sell the bonds for more money or make them easier to sell.

§ 16760 Bond Validity Legal Opinions

Whenever the committee deems that it will increase the salability or the price of the bonds to obtain, prior to or after sale, a legal opinion, other than that of the Attorney General, as to the validity of the bonds, the committee may authorize the State Treasurer or the Department of Finance, or both, to obtain such a legal opinion.
