§ 14131 Professional Services Contracting Limits

Key Takeaways

  • •The government can hire outside experts like engineers or architects for big projects, but only if they follow certain rules.
  • •These outside hires cannot replace or push out any current workers, even part-time or temporary ones.
  • •If a worker is forced to move, get a lower job, or lose their job because of these hires, that’s not allowed.
  • •The rules for hiring these experts are set by another law (Section 14134).

Example

The government wants to build a new bridge and needs an engineer to help design it.

They can hire an engineer from outside, but they can’t fire or move their current workers to do it. If they have an engineer already working for them, they can’t replace that person with the new hire.
