§ 12541 State Property Escheat Actions

Key Takeaways

  • •If the state gets property because no one else owns it (like forgotten money or land), the Attorney General has to go to court to make it official.
  • •The Attorney General does this to make sure the property legally belongs to the state.
  • •This is only for things like money or land that no one else claims.

Example

If someone passes away and leaves money in a bank account with no family to claim it, the state might take it.

The Attorney General will go to court to prove that the money now belongs to the state because no one else has the right to it.
