§ 12262 Reinstatement Name Conflict Resolution

Key Takeaways

  • •If a court says a business can start again, but its name is too similar to another business, the Secretary of State can say no.
  • •The business must change its name to something different before it can start again.
  • •This rule is to stop people from getting confused between two businesses with similar names.

Example

A bakery called 'Sweet Treats' was closed by a court but is now allowed to open again. However, there's already another bakery named 'Sweet Treats' in the same town.

The bakery that was closed must pick a new name, like 'Tasty Delights,' before it can open again. This way, people won't mix up the two bakeries.
