§ 12237 State Archives Disclosure Rule

Key Takeaways

  • •After 75 years, all old papers and items kept by the State Archives become public and anyone can see them.
  • •This rule applies to everything already in the State Archives and anything new added later.
  • •If you give something new to the State Archives, they will tell you that it will become public after 75 years.
  • •The State Archives website must say that all items 75 years or older are open for everyone to see.

Example

Your great-grandfather wrote a letter to the governor in 1948, and it was stored in the State Archives.

In 2023, that letter is now over 75 years old, so anyone can go and read it because it’s no longer secret.
