§ 581 Emergency Cease And Desist

Key Takeaways

  • •The law lets a boss (commissioner) stop bad actions by banks or people running them if those actions could hurt the bank or its customers.
  • •The boss can act fast, without warning, if the bank might go broke, lose a lot of money, get weaker, or hurt its customers.
  • •The boss can order the bank or person to stop doing harmful things right away.

Example

A bank starts giving out too many risky loans to people who can't pay them back.

The boss can step in and tell the bank to stop giving out those loans because it could make the bank lose too much money and go broke, hurting everyone who uses the bank.
