§ 23062 Deferred Deposit Violation Penalties

Key Takeaways

  • •If a payday lender breaks the rules when giving or collecting a loan, they can't charge any fees or extra money—only the original loan amount can be collected.
  • •The lender can avoid this penalty if they prove the mistake was accidental, not on purpose, and they fixed it within 30 days.
  • •The lender must tell the customer about the mistake and fix it by correcting the papers or account.

Example

You take out a $300 payday loan, and the lender charges you an extra $50 fee by mistake.

If the lender didn’t mean to charge the extra fee and fixes it within 30 days by giving you the $50 back, they won’t lose all their fees. But if they don’t fix it or did it on purpose, they can’t charge you any fees at all—just the $300 you borrowed.
