§ 18495 Appeals From Court Judgments

Key Takeaways

  • •If the commissioner or Guaranty Corporation doesn't like the court's decision, they can ask a higher court to look at it again.
  • •Just asking for another look doesn't stop the first decision from happening unless the court says so for a good reason.

Example

Imagine the court says a company must pay money to someone, but the company thinks it's unfair.

The company can ask a higher court to check if the first decision was right. But even while waiting, the company might still have to pay unless the court says 'wait' for a good reason.

§ 18495 Appeals From Court Judgments

An appeal may be taken from the judgment of the court by the commissioner or by Guaranty Corporation in the manner provided by law for appeals from the judgment of a superior court to the court of appeal. An appeal from the judgment of the court does not operate as a stay of the judgment unless the court, on good cause, so orders. (Amended by Stats. 1998, Ch. 931, Sec. 150. Effective September 28, 1998.)
