§ 1782 Foreign Bank Office Relocation

This law says a foreign bank that runs a representative office in the state must get the commissioner's approval before moving the office, and the commissioner can only approve it if the move won't hurt public convenience, or if it helps public convenience in the new area.

Key Takeaways

  • •A foreign bank needs the commissioner's approval to relocate its representative office.
  • •Approval depends on whether the move harms or helps public convenience, especially if the new site is far away.
  • •After approval, the bank must surrender its old license.

Example

A foreign bank based in another country wants to move its representative office from downtown Los Angeles to a new location in Santa Monica.

The bank must first ask the state banking commissioner for permission. The commissioner will check if the new site is in the same area; if it is, they must see that the move won't hurt public convenience. If the new site is far away, the commissioner must also see that moving the office won't hurt the public in the old area and that it will actually help the public in the new area. Once approved, the bank gets a new license and must turn in the old license.

(b) If the commissioner finds the following with respect to an application by a foreign (other nation) bank for approval to relocate a representative office, the commissioner shall approve the application: (1) In case the new site of the office is in the same vicinity as the old site, that the relocation of the office will not be substantially detrimental to the public convenience and advantage; or (2) In case the new site of the office is not in the same vicinity as the old site: (A) That the relocation of the office from the old site will not be substantially detrimental to the public convenience and advantage in the area that is primarily served by the office at the old site; and (B) That the relocation of the office to the new site will promote the public convenience and advantage. If the commissioner finds otherwise, the commissioner shall deny the application. (c) Whenever an application by a foreign (other nation) bank for approval to relocate a representative office has been approved and all conditions precedent to the issuance of a license authorizing the bank to maintain the office at the new site have been fulfilled, the commissioner shall issue the license.
