§ 17644 Credit Claim Presentation

This law requires anyone who wants to make a claim against a company that holds money in trust to send a written, signed claim to the commissioner within a set deadline, or they lose the right to pursue that claim.

Key Takeaways

  • •Submit any claim in writing to the commissioner.
  • •The claim must be signed or verified by the claimant or their representative.
  • •It must be filed within the deadline given in the notice.
  • •If the deadline is missed, the claim is permanently barred.

Example

A homeowner who paid money into an escrow account wants to get the money back because the company didn't finish the work.

The homeowner must mail a written, signed claim to the commissioner before the deadline shown in the notice. If they miss that deadline, they can no longer ask for the money back, even if they later decide to sue.
