§ 1757 Foreign Bank Office Approval

This law says that when a foreign bank wants to open a branch in California, the regulator can assume its leaders are honest unless there is proof they have committed fraud, lied, or broken certain rules.

Key Takeaways

  • •Bank leaders are presumed honest unless there is evidence of wrongdoing.
  • •Convictions or civil judgments for fraud, lying on applications, or losing professional licenses can disqualify them.
  • •The listed reasons are not the only grounds; other misconduct can also be used.

Example

A bank from another country wants to open a office in California. One of its directors was previously convicted of fraud.

Because the director has a fraud conviction, the regulator can decide the director is not of good character and may block the bank's application to open the office.
