§ 1714 Foreign Bank Office Relocation

This law says a foreign bank without insurance must get the state commissioner’s okay and a new license before it can move its office, and it must give back the old license after the move.

Key Takeaways

  • •Uninsured foreign banks need commissioner approval before moving a branch.
  • •Moving nearby is okay if it doesn’t hurt the public; moving far away must not hurt the old area and must help the new area.
  • •After the move, the bank must surrender the old license and get a new one for the new location.

Example

A bank from another state has a branch in City A and wants to move that branch to City B, which is a different neighborhood.

The bank must ask the commissioner for permission. If the new spot is far away, the commissioner will only say yes if moving won’t hurt the people who used the old branch and if the new spot will help the community. If approved, the commissioner gives a new license for City B and the bank turns in the old license for City A.

(2) In case the new site of the office is not in the same vicinity as the old site, both of the following: (A) The relocation of the office from the old site will not be substantially detrimental to the public convenience and advantage in the area that is primarily served by the office at the old site. (B) The relocation of the office to the new site will promote the public convenience and advantage. If the commissioner finds otherwise, the commissioner shall deny the application. (c) Whenever an application by an uninsured foreign (other state) bank for approval to relocate a facility has been approved and all conditions precedent to the issuance of a license authorizing the bank to maintain the office at the new site have been fulfilled, the commissioner shall issue the license.
