§ 12216 Applicant Background And Business Plan

This law says the commissioner must check who you are, what your business plan looks like, and any other important facts before giving you a license, and if everything is okay, they will hand you the license.

Key Takeaways

  • •The commissioner must investigate the applicant’s background and experience.
  • •The commissioner must review a detailed business plan covering market study, financials, service area, accounting, internal controls, and future expansion.
  • •If the applicant meets all requirements and no disqualifying facts are found, the commissioner issues the license.

Example

A person wants to open a new travel agency and applies for a license.

The commissioner will look at the owner's work history, the agency's business plan (including market study, financial forecasts, service area, accounting system, internal controls, and growth plans), and any other relevant details. If nothing shows a reason to deny the license, the commissioner will issue the travel agency a license to operate.
