§ 12201 License Application Requirements

This law says that to get a license you must fill out a written, sworn form that lists the names and addresses of everyone involved, and the commissioner can choose whether to allow electronic forms or signatures, but doesn’t have to.

Key Takeaways

  • •License applications must be written, under oath, and include the names and addresses of all owners, partners, officers, or directors.
  • •The commissioner can set rules to accept electronic records or signatures, but the law does not require the commissioner to do so.
  • •An “electronic record” covers many things like applications, reports, decisions, and notices, while an “electronic signature” is any electronic sound, symbol, or process used to sign those records.
  • •The department is encouraged to use more electronic filing when it has the budget and equipment.

Example

A small bakery wants a health permit. The owners fill out a paper application that lists the bakery’s address and each owner’s home address, and they sign it under oath.

Because the law requires a written, sworn application with all owners’ info, the bakery must submit a paper form. If the commissioner later decides electronic filings are allowed, the bakery could submit the same info online, but the law doesn’t force the commissioner to accept it.

(d) The Legislature finds and declares that the Department of Financial Protection and Innovation has continuously implemented methods to accept records filed electronically, and is encouraged to continue to expand its use of electronic filings to the extent feasible, as budget, resources, and equipment are made available to accomplish that goal.
