§ 8389 Herring Egg Harvest Permits

Key Takeaways

  • •You need a special permit to collect herring eggs for selling, and you can't sell or give this permit to someone else.
  • •You have to pay at least $50 for every ton of herring eggs you take, on top of other fees.
  • •The government can limit how many permits they give out and how many herring eggs can be taken to protect the fish and keep things fair.
  • •If you have this permit, you don’t need another permit for any seaweed or plants you accidentally pick up while collecting herring eggs.

Example

A fisherman wants to collect herring eggs to sell to restaurants.

The fisherman must first get a special permit that he can’t sell or transfer. He also has to pay $50 for every ton of herring eggs he collects. If the government thinks too many herring eggs are being taken, they might not give him a permit or might limit how much he can collect.

§ 8389 Herring Egg Harvest Permits

(a) Herring eggs may only be taken for commercial purposes under a revocable, nontransferable permit subject to such regulations as the commission shall prescribe. In addition to the license fees provided for in this code, every person taking herring eggs under this section shall pay a royalty, as the commission may prescribe, of not less than fifty dollars ($50) per ton of herring eggs taken. (b) Whenever necessary to prevent overutilization, to ensure efficient and economic operation of the fishery, or to otherwise carry out this article, the commission may limit the number of permits which are issued and the amount of herring eggs taken under those permits. (c) In limiting the number of permits, the commission shall take into consideration any restriction of the fishing area and the safety of others who, for purposes other than fishing, use the waters from which herring eggs are taken. (d) Every person operating under a permit issued pursuant to this section is excepted from the provisions of Chapter 6 (commencing with Section 6650) of Part 1 of Division 6 for aquatic plants taken incidental to the harvest of herring eggs. (Amended by Stats. 1988, Ch. 1009, Sec. 5.)
