§ 8246 Commercial Salmon License Settlements

Key Takeaways

  • •If the state wants to take away someone’s salmon fishing license, they can sometimes make a deal instead of punishing them fully.
  • •The deal might include paying money, getting a shorter punishment, or other rules the person agrees to follow.
  • •If the person breaks the deal, the state can still take away their fishing license after a hearing.
  • •This rule doesn’t apply if the state is also suing the person for money damages in a separate case.

Example

A fisherman gets caught breaking fishing rules, and the state wants to take away his license for a year.

Instead of losing his license for a whole year, the fisherman agrees to pay a fine and only stop fishing for 3 months. But if he breaks this deal, the state can still take his license away for the full year.

(b) The commission, after notice and opportunity for hearing, may suspend or revoke the commercial fishing privilege, authorized under a license issued for the purposes of Section 7850, for any violation of a term or condition of an agreement to compromise or dismiss a separate suspension or revocation action that was made pursuant to subdivision (a). (c) If the commission orders a suspension or revocation of a person’s commercial salmon fishing privilege, any permit issued pursuant to this article shall be renewed when the next renewal is due or the permit shall expire as provided in Section 8233.
