§ 6023 Fish Screen Installation Notice

(a) The department shall serve written notice upon each owner of its intention to install a fish screen. (b) The notice shall describe the location of the screen, the access required, and the amount of water required for the bypass. The location of the screen may be described by the distance downstream from the intake or by another method. (c) The notice shall be served upon the owner in duplicate. (d) Once signed by the owner, the notice shall serve as an agreement to the installation of the screen or device, according to the terms set out in the notice. (e) The signed agreement shall require the owner to render any assistance, other than mechanical repair or replacement of parts, necessary to keep the screen or device in satisfactory operating condition. The hiring of additional labor shall not be required for that assistance. (Amended by Stats. 2023, Ch. 132, Sec. 118. (AB 1760) Effective January 1, 2024.)
