§ 200 Wildlife Regulation Authority

This law lets the wildlife commission make rules about catching or keeping birds, mammals, fish, amphibians, and reptiles, but it does NOT let them make rules about commercial fishing or about certain young or special deer.

Key Takeaways

  • •The commission can regulate taking or possessing most wildlife (birds, mammals, fish, amphibians, reptiles).
  • •It cannot regulate commercial fishing, amphibian harvesting, kelp, or other aquatic plants.
  • •It also cannot regulate taking or possessing a "spike buck" or a "spotted fawn" (young or special deer).
  • •Other existing wildlife rules still apply to the things the commission can’t regulate.

Example

A hunter wants to catch a regular deer, but a fisherman wants to sell a lot of trout to a market.

The commission can set hunting rules for the regular deer, but it cannot set rules for the fisherman’s commercial trout business because commercial fishing is excluded by the law.
