§ 15405 Water Bottom Lease Terms

This law says the first time you lease state water bottom space, you can only get it for up to 25 years, but if you’re leasing it to raise marine finfish (like salmon), the first lease can only be up to 10 years.

Key Takeaways

  • •Initial state water bottom leases can’t be longer than 25 years.
  • •If the lease is for marine finfish aquaculture, the limit is only 10 years.
  • •These limits apply only to the first (initial) lease term.

Example

A company wants to lease part of the ocean floor to grow seaweed. They can ask for a lease that lasts up to 25 years. Another company wants to lease ocean floor to raise salmon. Their lease can only be up to 10 years.

The seaweed company follows the 25‑year rule because it’s not finfish. The salmon company follows the special 10‑year rule for marine finfish aquaculture.
