§ 7890 Child’S Wishes In Proceedings

Key Takeaways

  • •The court will listen to what the child wants, but thinks about their age too.
  • •The court always does what is best for the child, not just what the child wants.
  • •Even if a kid is young, their opinion still matters a little.

Example

A 10-year-old tells the judge they want to live with their dad instead of their mom.

The judge will listen to the kid but also check if living with dad is really the best choice for them. If dad works all night and isn’t home, the judge might say no, even if the kid wants it.
