§ 772 Post-Separation Earnings Ownership

Key Takeaways

  • •If a couple legally separates, their money and stuff stay their own.
  • •Any new money or things they get after separating belong only to them, not their ex.
  • •This rule starts working once the court says they are legally separated.

Example

A husband and wife legally separate. After that, the husband gets a big bonus at work.

The bonus money is only his, and his wife has no right to it because they were already separated when he got it.
