§ 7667 Termination Of Parental Rights

Key Takeaways

  • •If someone wants to end a dad's rights to his child, the court must have a hearing within 45 days of asking.
  • •This case will be more important than other cases on the same day, except for other cases about ending parental rights.
  • •The court can skip the hearing and just sign the order if: the dad can't be found, he signed a paper saying he's not the dad, or he didn't respond to a notice about the case in 30 days.

Example

A mom wants to let her new husband adopt her child, but the child's biological dad is not involved.

The mom asks the court to end the biological dad's rights. If the dad can't be found or doesn't respond to the notice within 30 days, the court can sign the order without a hearing.
