§ 7580 Minor Parentage Declaration Rules

Key Takeaways

  • •If a parent is under 18 when they sign a paper saying they are the parent, it doesn’t officially count until 60 days after they turn 18 or become emancipated (live on their own).
  • •A young parent can change their mind and cancel the paper up to 60 days after they turn 18 or become emancipated.
  • •The paper can be used in court to help prove who the parent is, but not in criminal cases about underage relationships.

Example

A 16-year-old signs a paper saying they are the parent of a baby. When they turn 18, they have 60 days to decide if they want to cancel it.

The paper doesn’t officially make them the parent until 60 days after they turn 18. If they change their mind within those 60 days, they can cancel it.
