§ 3692 Support Order Modification Limits

Key Takeaways

  • •A support order (like child support or alimony) can't be canceled just because it was unfair when it was made.
  • •Even if things change later (like someone gets a better job or loses money), the support order won't automatically change.
  • •You can't just say 'this isn't fair now' to get rid of the order.

Example

A dad was ordered to pay $500 a month for his kid. Later, he loses his job and can't afford it.

The court won't automatically cancel the $500 payment just because he lost his job. He still has to follow the order unless he goes back to court and proves a big change.

§ 3692 Support Order Modification Limits

Notwithstanding any other provision of this article, or any other law, a support order may not be set aside simply because the court finds that it was inequitable when made, nor simply because subsequent circumstances caused the support ordered to become excessive or inadequate.
