§ 2025 Bifurcated Issue Appeals

This law lets a lower court send a part of a case to a higher court for review before the whole case is finished, if the lower court says it's okay.

Key Takeaways

  • •This only happens if the lower court says it's okay.
  • •It's for when a part of the case is split off to be looked at separately.
  • •The higher court can then make a decision on just that part.

Example

Imagine a big court case about a car accident where one part is about who caused the crash and another part is about how much money should be paid.

The lower court can decide to send just the 'who caused the crash' part to a higher court to review, if they think it's important enough to check now instead of waiting for the whole case to finish.

Certification by the court shall be in accordance with rules promulgated by the Judicial Council. (Enacted by Stats. 1992, Ch. 162, Sec. 10. Operative January 1, 1994.)
