§ 861 Commercial Produce Ownership Records

Key Takeaways

  • •If you sell big amounts of fruits, nuts, or veggies (over 25 pounds) or walnut wood (over 200 pounds), you must show proof you own them.
  • •If you buy these things to sell or use later, you must get proof from the seller that they own them.
  • •If you move these things for work, you must carry proof that you or your company owns them.

Example

A farmer sells 50 pounds of apples to a grocery store.

The farmer must give the store a paper or record showing he owns the apples. The store must keep this paper to prove they bought them legally. If a truck driver moves the apples, they must also have this paper while driving.
