§ 79293 Commission Suspension Process

Key Takeaways

  • •A group (commission) can ask to pause their own rules if they think the rules aren't working. But they need a big vote (two-thirds) to do this.
  • •Farmers and sellers (producers and handlers) can also ask for a pause. They need to get 15% of farmers and 15% of sellers to sign a paper asking for it.
  • •If enough people ask, everyone gets to vote. The vote lasts 10-60 days. To pause the rules, at least 40% of farmers and 40% of sellers must vote, and most of them must agree to pause.
  • •The pause doesn’t happen right away—it starts after the current selling season ends.

Example

Imagine a group of blueberry farmers and sellers in California think the rules for selling blueberries aren’t helping anyone. They want to pause the rules.

First, the group in charge (the commission) can vote to ask for a pause. If they don’t, the farmers and sellers can collect signatures from 15% of farmers and 15% of sellers to ask for a vote. If the vote happens, at least 40% of farmers and 40% of sellers must vote, and most of them must say ‘yes’ to pause the rules. The pause won’t start until the current blueberry selling season is over.

§ 79293 Commission Suspension Process

(a) Upon a finding by a two-thirds vote of the commission that the operation of this chapter has not tended to effectuate its declared purposes, the commission may recommend to the secretary that the commission be suspended. Any suspension shall not become effective until the expiration of the current marketing season. (b) The secretary shall, upon receipt of a recommendation, or may, after a public hearing to review a petition filed with him or her requesting such suspension, signed by 15 percent of the producers by number who produced not less than 15 percent of the volume in the immediately preceding marketing season and 15 percent of the handlers by number who handled not less than 15 percent of the volume in the immediately preceding marketing season, cause a referendum to be conducted among the listed producers and handlers to determine if the operations of the commission shall be suspended. However, the secretary shall not hold a referendum as a result of the petition unless the petitioner shows by the weight of evidence that this chapter has not effectuated its declared purposes. (c) The secretary shall establish a referendum period, which shall not be less than 10 days or more than 60 days in duration. The secretary may prescribe additional procedures necessary to conduct the referendum. At the close of the established referendum period, the secretary shall tabulate the ballots filed during the period. The secretary shall suspend the operation of this chapter, if the secretary finds the following: (1) At least 40 percent of the total number of producers from the list established by the secretary participate, and that either of the following occurs: (A) Sixty-five percent of the producers who voted in the referendum voted in favor of suspension, and the producers so voting produced a majority of the total quantity of blueberries produced in the preceding marketing season by all of the producers voting in the referendum. (B) A majority of the producers who voted in the referendum voted in favor of suspension, and the producers so voting produced 65 percent or more of the total quantity of blueberries produced in the preceding marketing season by all of the producers voting in the referendum. (2) At least 40 percent of the total number of handlers from the list established by the secretary participate, and that either of the following occurs: (A) Sixty-five percent of the handlers who voted in the referendum voted in favor of suspension, and the handlers so voting handled a majority of the total quantity of blueberries handled in the preceding marketing season by all of the handlers voting in the referendum. (B) A majority of the handlers who voted in the referendum voted in favor of suspension, and the handlers so voting handled 65 percent or more of the total quantity of blueberries handled in the preceding marketing season by all of the handlers voting in the referendum.
