§ 77226 Pepper Handler Definitions

Key Takeaways

  • •A 'handler' is someone who sells or markets peppers they grew, bought, or got from a farmer. This includes owners, workers, or brokers.
  • •If you handle less than 100 tons of fresh peppers (or the same amount in dried peppers or seeds) in a year, you’re not considered a 'handler' under this law.
  • •The 100-ton limit can go up if two-thirds of the commission votes for it.
  • •The 100-ton limit can only go down if most people vote 'yes' in a special vote (referendum).

Example

A small farmer sells 50 tons of fresh peppers at the local market every year.

This farmer doesn’t count as a 'handler' because they sell less than 100 tons. So, the rules for handlers don’t apply to them.
