§ 76717 Council Member Liability Protection

Key Takeaways

  • •Council members or workers can't be personally sued for council contracts or agreements.
  • •Any money owed because of the council's work must come from the council's own funds, not from the members' pockets.
  • •If something goes wrong with a council deal, the council pays, not the individual people working there.

Example

A council signs a contract to fix a park, but the company does a bad job and someone gets hurt.

The hurt person can't sue the council worker who signed the contract. Instead, any money owed must come from the council's budget, not the worker's personal money.
