§ 74995 Commission Funds Distribution Rules

Key Takeaways

  • •If the commission stops working, any leftover money must be given back to the people who paid into it.
  • •If the leftover money is too small to split fairly, it can be given to a university or government program that does similar work.
  • •If no such program exists, the money goes to the state as unclaimed funds.

Example

A group of farmers paid money to a commission that helped sell their crops. The commission closed down.

The leftover money from the commission should be given back to the farmers. But if the amount is too small to split, it might go to a school or government program that helps farmers instead.

§ 74995 Commission Funds Distribution Rules

After the effective date of suspension of this chapter, the operations of the commission shall be concluded and any and all funds remaining held by the commission and not required to defray the expenses of concluding and terminating the commission shall be returned on a pro rata basis to all persons from whom assessments were collected in the immediately preceding marketing season. However, if the commission finds that the amounts so returnable are so small as to make impractical the computation and remitting of the pro rata refund to these persons, any funds shall be paid into an appropriate program conducted by the University of California or the California State University, another state agency, or a federal agency which deals with the purposes of this chapter. If no program exists, the funds shall be paid into the State Treasury as unclaimed trust funds. (Added by Stats. 1986, Ch. 1287, Sec. 4.)
