§ 5432 Nuisance Abatement Lien Priority

Key Takeaways

  • •If the city tells someone to fix a problem (like a dangerous building), they send a notice.
  • •This notice gets recorded and sent to anyone who has a loan or claim on the property.
  • •The city’s demand to fix the problem comes before most other money claims on the property.
  • •But tax bills and government fees still come first.

Example

A house is falling apart and the city says the owner must fix it.

The city sends a notice to the owner and the bank that has a loan on the house. The city’s order to fix the house is more important than the bank’s loan, but property taxes still have to be paid first.
