§ 5430 Abatement Expense Land Lien

Key Takeaways

  • •If the county tells you to fix something on your land and you don’t, they can do it themselves and make you pay.
  • •The county can put a legal claim on your land until you pay them back for the work they did.
  • •If the problem affects multiple properties (like a shared water ditch), the cost is split between all the owners based on how much land they have.

Example

Your neighbor’s broken fence is making water flood your yard, and the county tells them to fix it. They ignore the warning, so the county fixes it themselves.

The county will send your neighbor a bill for the repair. If they don’t pay, the county can put a lien on their property, meaning they can’t sell it until they pay up. If the fence problem affects multiple yards, the cost is split fairly between all the neighbors.
