§ 52351 Seed Seller Registration Requirements

Key Takeaways

  • •If you sell seeds for farming or gardening in this state, you must sign up with the state every year to get permission.
  • •You don’t need to sign up if you’re a farmer saving seeds just for your own use.
  • •You also don’t need to sign up if you’re only growing seeds to make more seeds, not to sell them.
  • •If you already have a license to sell plants (like trees or flowers), you might not need to sign up for seeds, unless you’re also doing other seed-selling stuff.

Example

A farmer grows extra tomato seeds and wants to sell them at the local market.

The farmer must first sign up with the state every year to get permission to sell those seeds. If the farmer only keeps the seeds to plant on their own farm, they don’t need to sign up.
