§ 43038 Nuisance Abatement Consent Process

Key Takeaways

  • •If everyone agrees in writing, the officer can get rid of the problem right away.
  • •If someone says no, the officer has to follow extra steps to fix the problem.
  • •The officer can't just do whatever they want—rules must be followed.

Example

Your neighbor’s old junk car is leaking oil into the street, and the city officer asks all neighbors to sign a paper to remove it.

If everyone signs, the officer can tow the car away fast. If even one neighbor refuses, the officer has to go through more steps (like a hearing) to remove it.
