§ 43001 Penalty For Noncompliant Produce

Key Takeaways

  • •If you break the rules about selling fruits, nuts, or vegetables, you have to pay a fine.
  • •The fine is based on how much the bad fruits, nuts, or vegetables would be worth if they were good.
  • •The value is decided by the cheapest price for similar good fruits, nuts, or vegetables at that time and place.
  • •The money from the fine goes to the Department of Agriculture.

Example

The farmer has to pay a fine. The fine is the same as what the rotten apples would be worth if they were good apples. The price is based on the cheapest good apples sold nearby at that time.
