§ 27611 Sample Evidence Presumption

• •If a small sample is taken the right way, it can represent the whole batch.
• •This sample can be used as proof in court.
• •The other side has to prove the sample is wrong if they disagree.

A store sells a big bag of apples, and one apple is tested and found to be rotten.

The test on that one apple can be used as proof that the whole bag might be bad. If the store says the bag is fine, they have to prove the tested apple doesn’t represent the rest.
