§ 15076 Commercial Feed Seizure Analysis

This law says that any commercial animal feed that gets taken by the state has to be tested quickly, and the owner must be told the results; if the owner isn’t told in time, the feed must be let go.

Key Takeaways

  • •Seized commercial feed must be sampled and tested promptly.
  • •The director decides the reasonable time limit for testing.
  • •The owner must be told the test result right away.
  • •If the owner isn’t told within the set time, the feed must be released.

Example

A feed supplier’s truck is stopped and the feed is taken by officials because they suspect it might be unsafe.

The feed must be sampled and sent to a lab right away. The director sets how fast the test must happen. Once the lab finishes, the director must tell the supplier if the feed is bad. If the supplier doesn’t hear back by the deadline, the feed has to be released and the hold tag taken off.

§ 15076 Commercial Feed Seizure Analysis

Any lot of commercial feed which is seized and held pursuant to this chapter, unless previously analyzed by the director, shall be sampled and promptly analyzed within a reasonable period of time, as set by the director by regulation, after the seizure for the purpose of determining if such commercial feed is, in fact, in violation of the provisions of this chapter or the regulations adopted pursuant to it. The person having control of the feed shall be immediately notified by the director as to whether or not the sample was found to be in violation. If the results of analysis are not made known to the person having control of the feed within the period of time specified by the director by regulation, the lot of commercial feed being held shall be immediately released and the hold order or tag removed. (Repealed and added by Stats. 1972, Ch. 1275.)
