§ 12756 Plant Growth Regulation

This law explains what 'regulating plant growth' means and says it does NOT include normal plant food, nutrients, or safe vitamin‑hormone products.

Key Takeaways

  • •The law defines 'regulating plant growth' as using anything to speed up, slow down, or otherwise change how plants grow.
  • •Regular plant nutrients, trace elements, inoculants, and soil amendments are NOT considered 'regulating plant growth'.
  • •Vitamin‑hormone horticultural products that are safe, non‑toxic, and used for plant health are also excluded.

Example

A farmer sprays a chemical that speeds up the growth of corn plants.

Because the chemical is meant to change how fast the corn grows, it falls under the definition of 'regulating plant growth' and is covered by the law. If the farmer only uses regular fertilizer or a harmless vitamin‑hormone spray to keep the plants healthy, those are NOT covered.

§ 12756 Plant Growth Regulation

“Regulating plant growth” means the use of any substance or mixture of substances intended, through physiological action, for accelerating or retarding the rate of growth or rate of maturation, or for otherwise altering the behavior of plants or the produce thereof. However, it shall not include the use of substances to the extent that they are intended as plant nutrients, trace elements, nutritional chemicals, plant inoculants, and soil amendments. Also, “regulating plant growth” shall not be required to include at all the use of any of such of those nutriment mixtures or soil amendments as are commonly known as vitamin-hormone horticultural products, intended for improvement, maintenance, survival, health, and propagation of plants and are not for pest destruction and are nontoxic, nonpoisonous in the undiluted packaged concentration. (Repealed and added by Stats. 1974, Ch. 686.)
