§ 12674 Seized Plant Handling Restrictions

This law says you can't pick up, pack, ship, sell, move, destroy, or get rid of any plant or crop that has been taken by the state unless the director says it's okay or you have written permission.

Key Takeaways

  • •Only the director can decide what happens to seized plants or crops.
  • •You need a written order from the director before you can move, sell, or destroy the seized items.
  • •Doing any of those things without the director’s permission is illegal.

Example

A farmer's corn is seized by the state because it was grown without a proper permit.

The farmer cannot sell or even throw away that corn unless the director gives a written order saying it can be disposed of or used.
