§ 12614 Disposal Of Produce With Excess Pesticide Residue

If a batch of fruits or veggies is found to have pesticide levels higher than the legal limits, it can be thrown away according to other rules.

Key Takeaways

  • •Produce is tested for pesticide residues.
  • •If residues are higher than any maximum or allowed tolerance, the lot can be disposed of.
  • •The disposal must follow the steps set out in sections 12607, 12608, and 12609.

Example

A farmer's shipment of strawberries is tested and shows pesticide residue above the allowed amount.

Because the test shows too much pesticide, the state can order the strawberries to be destroyed following the disposal procedures in sections 12607, 12608, and 12609.
